Fonon.uz terms and procedure for the remote purchase of jewelry through the electronic trading platform
This document is issued by EMPIRE Jewelry LLC (TIN 308219012, hereinafter referred to as the “Seller”). Through the fonon.uz electronic trading platform, any individual or legal entity (hereinafter referred to as the “Buyer”) is presented with an official offer (public offer) for the sale of jewelry under the purchase terms and procedure set out below.
1. General rules
1.1.This offer is public in accordance with the current legislation of the Republic of Uzbekistan. Acceptance of this offer (agreement) expresses the Buyer’s consent to purchase jewelry in accordance with the procedure and conditions provided in this document.
1.2.The offer is considered concluded from the moment it is accepted, that is, from the moment the Buyer confirms the “I have read and agree to the terms of the public offer” checkbox in the fonon.uz electronic system.
1.3.The Seller ensures the confidentiality of the Buyer’s data in accordance with the requirements of the legislation of the Republic of Uzbekistan.
1.4.This public offer is executed in accordance with the current legislative acts of the Republic of Uzbekistan, including Part Three of Article 364 and Articles 365, 367, 369 and 370 of the Civil Code of the Republic of Uzbekistan, and has legal force as a public offer.
2. Subject of the public offer
2.1.The subject of this offer is the regulation of relations between the Seller and the Buyer related to the sale and purchase of jewelry through the Fonon.uz electronic trading platform. The Seller undertakes to sell the jewelry presented on the electronic trading platform (except in the cases specified in this offer), and the Buyer undertakes to accept and pay for the goods in accordance with the terms of this offer.
2.2.Current product descriptions are displayed on the product page of the website.
3. Price and payment procedure
3.1.The price of each product is displayed on the Fonon.uz electronic trading platform and includes all taxes and mandatory payments in accordance with current legislation. These prices are for informational and reference purposes and cannot be interpreted as fixed (unchangeable) prices. The Seller is not obligated to sell the product at this price. The Seller reserves the right to update or change prices as necessary.
3.2.Payment is made using one of the following methods:
- in cash upon delivery of the product;
- by bank card through a terminal upon delivery of the product;
- through Uzum Bank or other integrated payment systems when placing an order on the Fonon.uz electronic trading platform;
- in cash or by bank card at the store cash desk when collecting the product in person.
Payment may also be made using other methods not prohibited by law. The right to delivery or collection of the product arises after full payment.
3.3.By confirming an order on the Fonon.uz electronic trading platform, the Buyer expresses full agreement with the price, description and delivery terms of the product.
3.4.In the event of a technical or software error (for example, if the price is indicated as 0 soums or other clearly incorrect information is displayed), such an order is not considered valid and will not be fulfilled. Other technical failures beyond the Seller’s control may also occur on the Fonon.uz electronic platform.
3.5.If prepayment was made for an order affected by such an error, the amount paid by the Buyer, including delivery costs, will be refunded in full in accordance with the established procedure upon the Buyer’s request.
3.6.Prices displayed on the Fonon.uz website are for informational and reference purposes and may change due to fluctuations in global prices for precious metals and stones (including the London Bullion Market Association - LBMA market), exchange rates, customs and logistics costs, and other economic factors. If the price displayed on the Fonon.uz electronic platform differs from the price in Fonon stores, the store price applies.
3.7.The product is not guaranteed to be reserved until the Buyer has made full payment. If the product is sold or unavailable before payment is completed, the Seller is not responsible for that situation. At the Buyer’s request, a similar product will be offered or, if payment has already been made, the amount paid will be refunded in full.
3.8.If the Buyer has paid through the Fonon.uz electronic trading platform but the product is unavailable from the Seller or has been sold, the Seller is not obligated to deliver that product. The Buyer will be notified and, at the Buyer’s request, the amount paid will be refunded in full or another similar product will be offered.
4. Delivery and pickup procedure
4.1.Delivery of goods is carried out only within the territory of the Republic of Uzbekistan.
4.2.Delivery is carried out within 7 (seven) calendar days from the date the order is confirmed by the Seller. Delivery times may vary depending on the workload of the delivery service provider or transportation conditions.
4.3.Personal pickup address: 50 Malaya Koltsevaya Doroga Street, Chilanzar District, Tashkent, Republic of Uzbekistan.
4.4.During transportation, responsibility for the integrity of the goods lies with the delivery service provider. After the goods are delivered, responsibility for their damage or loss passes to the Buyer.
4.5.Upon receiving the goods, the Buyer must carefully inspect their appearance, integrity and completeness. If any damage, defect, shortage or other deficiency is found, the Buyer must immediately notify the delivery service employee or the Seller’s authorized representative (service center).
After the Buyer accepts the goods, the Seller is not responsible for any damage, breakage, loss or deterioration in quality occurring after acceptance. Once the goods have been handed over to the Buyer by the Seller or the delivery service representative, claims and complaints regarding the quality, integrity or external condition of the goods will not be accepted.
4.6.The Seller is not responsible for delivery delays caused by force majeure circumstances or delays in the transportation system.
5. Responsibility
5.1.The Seller is not responsible for damage resulting from the Buyer’s improper use of the goods, failure to comply with storage rules, or actions contrary to the natural structure of the goods.
5.2.Responsibility for the integrity and absence of damage to the goods during delivery lies with the delivery service provider. After the goods are delivered to the Buyer, responsibility for their damage or loss passes to the Buyer.
5.3.The Buyer is personally responsible for the correctness, relevance and reliability of the personal and contact information provided when placing the order. The Seller is not responsible for delays or inability to deliver resulting from incorrect information.
5.4.The Seller is not responsible for delayed payment by the Buyer or delayed receipt of funds due to technical failures of a bank or payment system.
5.5.The Seller is not responsible for temporary technical failures on the Fonon.uz electronic trading platform, internet connection interruptions or server downtime.
6. Force majeure circumstances
6.1.Neither party is liable for failure to perform its obligations due to natural disasters, war or military operations, epidemics, strikes, interruptions in transportation or communication systems, prohibitive or restrictive decisions of government authorities, or other circumstances beyond reasonable control (force majeure circumstances).
6.2.During a force majeure event, the time for both parties to perform their obligations is extended for the duration of such circumstances. If the circumstances continue for more than 60 (sixty) calendar days, the parties may discuss terminating the performance of their obligations or terminating the agreement.
6.3.Technical failures of the Fonon.uz electronic trading platform or related integrations, incorrect or delayed display of information, including erroneous price displays, do not impose additional obligations on the Seller, but the Buyer will be notified of the situation as soon as reasonably possible.
6.4.If a force majeure event occurs, each party must notify the other party as soon as possible. A certificate from the relevant government authority or authorized organization confirming the existence of the force majeure event will serve as the basis for confirmation.
7. Dispute resolution procedure
7.1.Any dispute, disagreement or claim that may arise in connection with this public offer will first be addressed through negotiations and written compromise between the parties.
7.2.If no agreement is reached through negotiations, the dispute will be resolved in court in accordance with the current legislation of the Republic of Uzbekistan.
7.3.All court cases will be considered by the courts at the Seller’s place of registration in Tashkent.
7.4.Any demand or claim submitted by the Buyer must be sent to the Seller’s address in writing and must clearly state the reasons for the dispute and the amount of the claim (if any).
7.5.The Seller maintains relationships of trust with customers and seeks to resolve disputes as peacefully as possible.
The Seller respects Buyers’ opinions, complaints and suggestions and considers it an obligation to review them in accordance with the law and internal rules.
8. Final rules
8.1.The Seller has the right to amend or supplement this public offer without prior notice to the Buyer. A new version enters into force when published on the Fonon.uz website and applies to orders placed after that time.
8.2.Disputes and disagreements arising between the parties are resolved in accordance with the current legislation of the Republic of Uzbekistan and are considered by the Tashkent Interdistrict Economic Court according to jurisdiction or by the relevant district civil courts located in Tashkent.
8.3.The order is delivered to the Buyer within 1 (one) to 5 (five) business days after confirmation by the Seller, but no later than 7 (seven) calendar days. The Buyer can track the order status through the personal account.
8.4.All relations connected with this public offer are governed by the Civil Code of the Republic of Uzbekistan and other applicable legislative acts unless otherwise provided by this document.
